These Terms of Service (“Terms”) govern your use of the DropSpot mobile application and related services (“DropSpot”, “App”, “Service”).

By downloading, accessing, or using DropSpot, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

DropSpot is intended for users who are at least 16 years old.

By using the App, you confirm that you meet this requirement and have the legal capacity to enter into these Terms.

2. Account & Proper Use

To use DropSpot, you must create an account and provide accurate information.

You are responsible for:

• All activity under your account
• Keeping your login credentials secure

You must not:

• Use the App for unlawful purposes
• Harass, threaten, or harm other users
• Upload illegal, misleading, or infringing content
• Attempt to access, manipulate, or interfere with the App or its systems

We may suspend or terminate accounts that violate these Terms or applicable laws.

3. Location-Based Features

DropSpot provides real-time, location-based features such as nearby users, proximity matching, live map updates, and location-based notifications.

Some core features require background location access.

You decide whether and when to share your location. However, disabling background location access may limit or disable essential features of the Service.

Location permissions can be changed or revoked at any time in your device settings.

4. User Content

You may create and share content such as text, images, profile information, or activity data (“User Content”).

You retain ownership of your User Content.

By posting content, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and process it solely for operating and improving the Service.

You are solely responsible for your User Content and must ensure it complies with applicable laws and these Terms.

5. Interactions & Real-World Meetings

DropSpot facilitates discovering and communicating with other users.

• We do not verify users or conduct background checks
• We are not responsible for the behavior of users online or offline
• Any meetings or interactions arranged through DropSpot occur at your own risk

Users are expected to act responsibly and with respect for others.

6. Paid Features & Advertising

DropSpot may offer paid features, boosts, or sponsored content.

• Prices are displayed clearly before purchase
• All payments are processed via the Apple App Store
• Refunds and billing are governed by Apple’s terms

DropSpot may display hyperlocal or contextual advertising, including offers from nearby venues. We do not sell personal data.

7. Intellectual Property

All content and materials provided by DropSpot (excluding User Content), including software, design, logos, and trademarks, are owned by or licensed to us and protected by law.

You may not copy, modify, distribute, or exploit any part of the App without prior written permission.

8. Privacy

Our processing of personal data is described in our Privacy Policy, which forms an integral part of these Terms.

Please review it carefully before using the App.

9. Availability & Changes

We may modify, suspend, or discontinue parts of the Service at any time, including for maintenance or updates.

We do not guarantee uninterrupted or error-free operation.

10. Disclaimer of Warranties

DropSpot is provided “as is” and “as available”.

We make no warranties regarding:

• Availability of users or events
• Accuracy of matches or content
• Outcomes of user interactions

11. Limitation of Liability

To the maximum extent permitted by law, DropSpot is not liable for indirect or consequential damages, including loss of data, revenue, or opportunities.

Our total liability is limited to the amount paid by you (if any) for the Service in the preceding 12 months.

12. Termination & Account Deletion

You may stop using DropSpot at any time.

You may delete your account at any time via the in-app settings.

Upon account deletion, your personal data is deleted in accordance with our Privacy Policy. Certain data may be retained only where legally required.

13. Governing Law

These Terms are governed by the laws of Germany, excluding conflict-of-law rules.

If you are a consumer in the EU, mandatory consumer protection laws of your country of residence remain unaffected.

14. Changes to These Terms

We may update these Terms from time to time.

Material changes will be communicated in-app or by other appropriate means. Continued use after changes constitutes acceptance.
